Terms of Use

These terms are between you and Hajar Rashidian-Zadeh, in Ontario, Canada ("we"), and cover the Tapefold apps and tapefold.app. Using Tapefold means agreeing to them. The privacy policy at tapefold.app/privacy says what we hold and why.

Tapefold uses the Telegram API and is part of the Telegram ecosystem. It is not an official Telegram app, and it is not made by Telegram, Dropbox, Offtop or Apple.

1. What Tapefold is

Tapefold lets you browse, search and play audio from sources you add yourself, keep your stars and sources in step across your devices, and keep chosen loops in your account's archive. It never searches Telegram, Dropbox or the web on your behalf.

It is in beta. Things will change and some will break. Tapefold is currently free. If it starts charging, we will tell you first, and payment will only ever be taken on tapefold.app, never inside an app.

2. Your account

  • You need an account, and during the beta an invitation. You must be 13 or older. If you are under the age of majority where you live (18 in Ontario), a parent or guardian must agree to these terms for you.
  • Keep your password to yourself. You are responsible for what happens on your account; tell us at [email protected] if you think someone else is using it.
  • An account is for one person. It can be signed in on up to 5 devices.

3. Your sources and your content

  • You add sources with your own Telegram, Dropbox and Offtop accounts, and those services' own terms keep applying to you. Tapefold does not change what you are allowed to do with their content.
  • What you archive is yours, and your responsibility. Archive only audio you have the right to keep a copy of. We do not own your audio. You give us permission to store it, and to send it back to your own devices, only so the archive works, and only while it is archived.
  • Nobody but you can reach your archive. Tapefold has no sharing, no public links and no way to send a loop to another account.

4. Things you must not do

  • Use Tapefold to break the law, or anyone's copyright.
  • Try to reach another person's account or data, or probe, overload or get around the limits of our server.
  • Resell Tapefold or build a service on top of it.
  • Use anything obtained through Tapefold to train, fine-tune or develop artificial intelligence. Telegram's terms forbid this for its content, and we forbid it for everything.

5. Copyright complaints and takedown

If you believe audio stored in a Tapefold archive infringes your copyright, write to [email protected] with: the work, why you hold the rights to it, how to reach you, and anything that identifies the file (its SHA-256, if you have it). We will remove the file and every account's copy of it that we can identify, and tell the account holders concerned. If we receive a notice that a file infringes copyright, we will pass it to the account holder, as Canadian law requires, and tell the sender we did. If you think a notice about your file is mistaken, write to [email protected] and we will pass your reply on to the sender.

6. Ending things

  • You can stop at any time, and ask us to delete your account (see the privacy policy).
  • We may suspend or close an account that breaks these terms. Except where the law or a threat to others requires otherwise, we will tell you first and give you a chance to download what you archived.
  • If we ever shut Tapefold down, we will give at least 30 days' notice so you can take your archived audio with you.

7. No warranty, and limits

Tapefold is provided as it is. We do our best to keep it working and your data safe, but we do not promise that it will always be available, that every loop will play, or that nothing will ever be lost. Keep your own copies of anything that matters.

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the twelve months before the claim, or CA$50 if you paid nothing.

We are not responsible for Telegram, Dropbox, Offtop or Apple, including if one of them changes, limits or ends what Tapefold can do with it.

8. Changes to these terms

If we change these terms in a way that matters, we will say so in the app or by email before the change applies. If you keep using Tapefold after that, the new terms apply.

9. Law

These terms are governed by the laws of Ontario and of Canada that apply there, and disputes go to the courts of Ontario, unless the law where you live gives you the right to bring them where you are.
